Participation Waiver – Scaling Up, LLC

This Participation Waiver and Agreement (“Agreement”) applies to all trainings, courses, retreats, and events (collectively, “Trainings”) offered by Scaling Up, LLC, a Nevada Limited Liability Company (“Scaling Up,” “Provider,” “we,” or “us”). By registering for or attending any Training, you (“Participant” or “you”) acknowledge and agree to be bound by the following terms.

1. Description of Trainings

Scaling Up provides a variety of EMDR-related Trainings, including but not limited to:

EMDR GAP Training (Formally known as the: EMDR Therapy Protocols for Early Intervention & Ongoing Traumatic Stress Training)
The EMDR GAP Training can teach you the Adaptive Information Processing (AIP)-informed psychophysiological algorithmic procedures (ASSYST), specially designed for clients that present intense or overwhelming sensory input, body sensations, or emotions. It can also teach you the EMDR-PRECI and the EMDR-IGTP-OTS – which are both advanced EMDR protocols.

Acute Stress Syndrome Stabilization (ASSYST) Procedure On Demand Training
The Acute Stress Syndrome Stabilization Remote (ASSYST) Procedure On Demand Training can teach you an Adaptive Information Processing (AIP)-informed psychophysiological algorithmic procedure specially designed for clients that present intense or overwhelming sensory input, body sensations, or emotions that can be used online/remotely for clients who cannot receive assistance otherwise.

EMDR Basic Training Parts I and II
The EMDR Basic Training Parts I and II, includes either online live or in-person training sessions and practicums, as well as 10 hours of consultation on EMDR Therapy, and reading an EMDR Therapy book by Francine Shapiro. This EMDR training is EMDRIA-Approved.

EMDR-IGTP-OTS-Remote On-Demand Training
During the EMDR-IGTP-OTS-Remote On-Demand Training you will observe a demonstration of the EMDR-IGTP-OTS Remote procedure, along with Q&As, documents and other supporting materials.

EMDR Therapy Refresher Course
During the EMDR Therapy Refresher Course you will learn a review of the EMDR Basic Training material through lecture and practicum. This course can be taken online, on demand at your own pace with no live practicum.

EMDR Intensives Course
The EMDR Intensives Course is an on demand training for EMDR clinicians to learn ways to conduct EMDR therapy in an intensive format with clients.

Hive Teachings
The Hive is an online training community & Continuing Education provider for mental health therapists creating systemic change and large-scale impact through: humanitarian work, rapid response teams, trauma recovery interventions, research, social justice and anti-oppression work.

Retreats
The Retreats consist of: EMDR Basic Training Retreats; EMDR Intensives Retreats; and the Be Bold Retreat. These are either in-person or live online. They vary between 1-7 days in length. Cost includes some lodging and food but no travel. Information varies per retreat and details can be found on the website.

Each Training may include lecture, demonstration, practicum, discussion, and access to course materials, either online or in person.

2. Demonstrations & Practicum Risks

All Trainings may include practicum exercises where participants act as therapist, client, and observer. These activities are designed for training purposes and may involve processing real-life or simulated material. You acknowledge that:

  • Such protocols have not been fully tested for all possible side effects.
  • Participation may evoke physical, psychological, or emotional reactions.
  • If you have concerns about potential effects, you should consult your physician or therapist before participating.

3. Assumption of Risk

By attending, you voluntarily assume all risks associated with participation, including but not limited to:

  • Emotional, psychological, or physical reactions;
  • Injuries, slips, falls, or accidents at in-person events;
  • Illness, including exposure to COVID-19 or other communicable diseases;
  • Internet outages, technical failures, or interruptions affecting online Trainings.

4. Waiver & Release of Liability

In consideration of being permitted to participate, you hereby waive, release, and discharge Scaling Up, LLC, its owners, trainers, facilitators, employees, contractors, and fellow participants (“Released Parties”) from any and all liability, claims, damages, costs, or expenses arising from or related to your participation, whether caused by negligence or otherwise. This release includes but is not limited to:

  • Bodily injury, illness, or psychological distress;
  • Property damage or financial loss;
  • Travel-related issues, delays, or cancellations;
  • Consequences of implementing or misapplying techniques learned.

5. Indemnification

You agree to indemnify, defend, and hold harmless Scaling Up, LLC and its Released Parties from and against all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your participation in any Training or your subsequent professional activities.

6. No Professional Advice

Trainings are for educational purposes only. They do not constitute legal, medical, or ethical advice and are not a substitute for consultation with a qualified professional (e.g., attorney, physician, or licensing board). You are solely responsible for ensuring compliance with your jurisdiction’s regulations.

7. Accuracy of Information

The information provided by Scaling Up and its trainers is accurate to the best of our knowledge at the time of publication. We assume no responsibility for errors, omissions, or subsequent changes in laws, regulations, or professional standards. It is your responsibility to remain current.

8. Responsibility of Trained Individuals

Therapists, NGO workers, and others trained by Scaling Up, LLC remain solely responsible for their professional services and conduct. All trainees and contractors must maintain their own malpractice and liability insurance. Scaling Up, LLC is not liable for the actions, omissions, or services provided by individuals trained by us.

9. Cancellation & Refund Policy

Cancellation and transfer policies may vary by course or training format. Please refer to the specific Training webpage for full details.

In general:

  • Some Trainings may allow refunds or transfers if canceled with sufficient notice.
  • On-demand trainings are typically non-refundable once purchased.
  • Participants remain responsible for all hotel, travel, and transportation arrangements.

Scaling Up reserves the right to apply administrative fees or restrictions as outlined on the applicable Training webpage.

10. Force Majeure

If Scaling Up is unable to conduct a Training due to events beyond its control (e.g., natural disasters, government restrictions, strikes, war, terrorism, pandemics, or internet outages), Scaling Up may reschedule or issue credits. Refunds, if any, will be limited to the registration fee and exclude travel or lodging costs.

11. Health & Safety

For in-person Trainings, participants must comply with all health and safety measures required by federal, state, and local authorities, as well as Scaling Up’s policies in effect at the time of the event.

12. Copyright & Intellectual Property

All Training content, including but not limited to materials, slides, recordings, and course documents, is protected by copyright. Reproduction, distribution, posting, or transmission without prior written consent of Scaling Up, LLC is prohibited.

13. Access to On-Demand Materials

On-demand materials are available for 90 days. Continued access can be purchased for $40 per month until canceled. Some courses do not expire—please refer to each course’s webpage for specific expiration details.

14. Photo & Video Consent

  • Scaling Up may photograph or record Trainings for educational or marketing purposes.
  • If you do not wish to be included in photos, notify staff in writing prior to the Training.
  • Online participants must keep cameras on during live sessions and present themselves professionally. Recordings may be shared with other participants at Scaling Up’s discretion.

15. Governing Law & Disputes

This Agreement shall be governed by Nevada law. Any disputes shall be resolved through binding arbitration under the Commercial Rules of the American Arbitration Association in Washoe County, Nevada. The prevailing party shall be entitled to recover reasonable attorney fees and costs.

16. Acknowledgment & Acceptance

By registering for and/or attending any Scaling Up Training, you confirm that:

  • You have read and understood this Agreement;
  • You voluntarily assume all risks associated with participation;
  • You release Scaling Up, LLC and its representatives from liability;
  • You agree to indemnify Scaling Up, LLC as described above.

By attending, you accept these terms in full.
