Scaling Up, LLC – Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of Scaling Up, LLC’s (“Scaling Up,” “we,” “us,” “our”) website, products, services, trainings, events, and communities. By registering for a training, accessing our website, or using our services, you agree to these Terms, which form a binding contract between you and Scaling Up, LLC.

Scaling Up’s services and trainings are intended for individuals aged 18 years and older. If you do not agree with these Terms, your sole remedy is to discontinue using our website, products, and services.

1. Entire Agreement

These Terms, along with our Privacy Policy, Disclaimer, Participation Waiver, any training-specific Participation Agreement, and any additional written policies referenced herein, constitute the entire agreement between you and Scaling Up, and supersede all prior agreements, understandings, and representations, except any separate written agreement signed by an authorized Scaling Up representative (such as a group, sponsor, grant, or government contract), which controls as to the terms it covers. If these Terms conflict with the Participation Agreement for a specific training, that Participation Agreement controls for that training.

2. Acceptance of Terms

  • By registering or using our services, you acknowledge you have read, understood, and agreed to these Terms.
  • We may update these Terms at any time. Updated versions will be posted at www.scalingupemdr.com. Continued use of the Site or services after updates constitutes acceptance. For a training you have already registered for, the version of the training-specific Participation Agreement in effect when your registration was confirmed continues to apply to that training.

3. Training & Program Requirements

Certain trainings, including EMDRIA-Approved EMDR Basic Training, have specific attendance and participation requirements. The full requirements for each training are in its Participation Agreement; the summary below is for convenience:

  • Attendance: You must attend all training sessions in full (Parts 1 & 2), or complete any required make-up, to receive a Certificate of Completion.
  • Consultation: You must complete 10 consultation hours (included in your fee). Missed or rescheduled sessions may require additional payment. Rates are set by each consultant and paid directly to them; they typically range from $50 to $150 per session.
  • Practicum: You will be required to participate as client, therapist, and observer during facilitated practicum exercises. Practicum may bring up unexpected trauma-related material. Let your facilitator know if you become distressed and consult your own physician or therapist if you have concerns before or after the training.
  • Timeline: All EMDR Basic Training requirements must be completed within 12 months of the first day of Part 1 you attend. Extensions are not automatic and may be approved by Scaling Up only under its Extension Policy for significant, documented circumstances outside your control.
  • Practice and other requirements: EMDR Basic Training also requires prework, required readings, learner assessment(s), and at least 10 separate EMDR reprocessing sessions involving Phases 4, 5, and/or 6 completed after Part 1, as described in the Participation Agreement.

4. Continuing Education (CE) Credits

Scaling Up offers CE credits where approved (such as APA, ASWB, and NBCC, as listed for each training). However:

  • CE approvals are granted by the accrediting bodies, not Scaling Up.
  • Scaling Up makes no guarantee that CE credits will be accepted by your licensing board or employer.
  • You are responsible for verifying CE eligibility with your regulatory/licensing authority.
  • CE fees, if any, are listed in the Participation Agreement or on the training webpage.

5. Technology & Access Responsibilities

For online/virtual trainings, you are solely responsible for:

  • Having a stable internet connection, updated device, and working audio/video.
  • Always keeping your camera on during live trainings (required for attendance verification), and not attending while driving, riding in a moving vehicle, flying, from a public space, or while actively responsible for childcare.
  • Ensuring your environment allows for privacy and professional participation, including joining from a private location where others cannot see or overhear the training.

Scaling Up is not responsible for participant technical failures. Time missed because of your own technical problems counts as missed time and must be made up as described in the training’s Participation Agreement.

6. Cancellation, Refund, & Transfer Policy

Because trainings are time- and resource-intensive, Scaling Up enforces cancellation and transfer policies. The exact timelines, fees, and conditions vary depending on the training type (e.g., Basic Training, GAP Training, Intensives, On-Demand).

The applicable policy for your specific training will be provided to you at registration and forms part of this Agreement. By registering, you agree to abide by the training-specific cancellation and transfer terms.

General Principles (apply to all trainings):

  • Cancellation and transfer requests must be submitted in writing.
  • Administrative fees often apply to cancellations and transfers.
  • Refunds apply only to the training registration fee; Scaling Up is not responsible for travel, lodging, or other costs.
  • Unless the training-specific policy says otherwise, refunds are not available once a training has started. Transfers are available as described in the training-specific policy or, if that policy does not address it, at Scaling Up’s discretion.
  • If Scaling Up cancels or reschedules a training, your options are described in the training-specific policy and the Participation Waiver.
  • Check each training’s webpage for details about that training’s cancellation and transfer policy.

7. Copyright & Intellectual Property

  • All Scaling Up training materials, website content, presentations, slides, recordings, and resources (“Content”) are the intellectual property of Scaling Up, LLC.
  • Content may not be reproduced, shared, distributed, recorded, stored, or transmitted without prior written permission from Scaling Up. This includes uploading Content into artificial intelligence (AI) tools.
  • Use of Content is strictly limited to personal, professional development. Commercial use is prohibited.
  • Access to on-demand courses and online materials is for the individual registrant only. Sharing login credentials or course access with others is prohibited.
  • Unauthorized use of Scaling Up intellectual property may result in legal action, including injunctive relief.

8. Media Consent

Portions of events may be recorded (audio, video, or photography). Practicum exercises and consultation groups are never recorded, to protect participants’ personal material. By attending, you consent to being recorded during the portions that are recorded and waive any right to compensation for their use.

Recordings may be used for training and educational purposes. Photos or video in which you can be identified will only be used in marketing materials with your written consent. If you do not wish to be photographed or recorded, please notify Scaling Up in writing before training begins.

9. Community Guidelines

Scaling Up communities (online and in-person) are professional spaces. By participating, you agree to:

  • Be respectful and constructive; harassment or disruptive behavior will not be tolerated.
  • Not solicit, advertise, or pitch services/products.
  • Keep discussions confidential; do not share or repurpose content outside the group.
  • Not use AI notetaking, transcription, or recording tools during live trainings, as described in the Participation Agreement for your training.
  • Follow moderator instructions.

Scaling Up reserves the right to remove any participant whose behavior is disruptive, unsafe, who appears intoxicated, or is otherwise inconsistent with maintaining a professional learning environment. Removal may occur at Scaling Up’s sole discretion and does not entitle the participant to a refund, credit, or transfer.

10. Disclaimers

  • Educational Purposes Only: Trainings, materials, and content are educational. They are not individualized medical, legal, or clinical advice about a specific client or situation, and consultation provided as part of a training is educational, not clinical supervision.
  • No Guarantee of Results: Scaling Up makes no guarantee regarding outcomes, earnings, licensure, EMDRIA Certification, or clinical results from trainings.
  • Accuracy: We strive for accuracy but do not guarantee that all content is current, complete, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law:

  • Scaling Up, LLC and its owners, trainers, contractors, and staff are not liable for indirect, incidental, or consequential damages arising from your participation in trainings or use of our content, and their total liability for any claim will not exceed the amount paid to Scaling Up for the training or product at issue. This does not limit liability for gross negligence or intentional misconduct.
  • You assume all risks associated with practicum exercises, participation, and application of learned techniques.
  • Each trainee is independently responsible for their professional actions and responsible for maintaining any liability or malpractice insurance required for their practice.

12. Indemnification

You agree to indemnify and hold harmless Scaling Up, LLC, its owners, trainers, contractors, and affiliates from claims, damages, losses, liabilities, or expenses (including attorney’s fees) brought by third parties, including your clients, arising from:

  • Your breach of these Terms or any Participation Agreement; or
  • Your clinical or professional practice, including your use or misuse of techniques learned;

13. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the State of Nevada, USA.
  • If you have a concern, please first contact kelly@scalingupemdr.com in writing and allow 30 days to try to resolve it informally. Any dispute that is not resolved informally will be resolved by binding arbitration on an individual basis in Washoe County, Nevada, under the rules of the arbitration provider selected by counsel, and may be conducted by video. Either party may instead bring an individual claim in small claims court, and Scaling Up may ask a court to stop unauthorized use of its intellectual property. If a Participation Agreement applies, its dispute terms control.

14. Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions will remain valid and enforceable.

15. Accessibility & Accommodations

Scaling Up is committed to making its trainings accessible. If you need a disability-related accommodation or will attend with a service animal, please let us know at least 10 days before the training begins so we can coordinate with the venue or online platform. We will share only what is necessary to arrange your accommodation. We will still do our best to accommodate requests made later. Advance notice is requested, not required; you will not be turned away from training with a service animal because you did not tell us ahead of time. See the Participation Agreement for your training for the full service animal policy.

16. Acknowledgment

By registering, you confirm that you:

  • Are at least 18 years old and legally competent to consent.
  • Have read and fully understood these Terms.
  • Accept responsibility for your participation and your own clinical practice.
  • Agree to the Participation Waiver, limits on liability, and dispute resolution terms described in these Terms and in any applicable Participation Agreement.
