Scaling Up, LLC – Terms & Conditions
These Terms and Conditions (“Terms”) govern your use of Scaling Up, LLC’s (“Scaling Up,” “we,” “us,” “our”) website, products, services, trainings, events, and communities. By registering for a training, accessing our website, or using our services, you agree to these Terms, which form a binding contract between you and Scaling Up, LLC.
Scaling Up’s services and trainings are intended for individuals aged 18 years and older. If you do not agree with these Terms, your sole remedy is to discontinue using our website, products, and services.
1. Entire Agreement
These Terms, along with our Privacy Policy, Disclaimer, and any additional written policies referenced herein, constitute the entire agreement between you and Scaling Up. They supersede all prior agreements, understandings, and representations.
2. Acceptance of Terms
- By registering or using our services, you acknowledge you have read, understood, and agreed to these Terms.
- We may update these Terms at any time. Updated versions will be posted at www.scalingupemdr.com. Continued use of the Site or services after updates constitutes acceptance.
3. Training & Program Requirements
Certain trainings, including EMDRIA-Approved EMDR Basic Training, have specific attendance and participation requirements:
- Attendance: You must attend all training sessions in full (Parts I & II) to receive a Certificate of Completion.
- Consultation: You must complete 10 consultation hours (included in your fee). Missed or rescheduled sessions may require additional payment ($65–$80 per session or more, depending on the consultant).
- Practicum: You will be required to participate as client, therapist, and observer during supervised practicum exercises. Practicum may bring up unexpected trauma-related material. You are responsible for your well-being and should consult your own physician or therapist if you have concerns.
- Timeline: EMDR Basic Training must be completed within 12 months of your start date. Extensions may only be requested from EMDRIA.
4. Continuing Education (CE) Credits
Scaling Up offers CE credits where approved (APA, ASWB, NBCC, etc.). However:
- CE approvals are granted by the accrediting bodies, not Scaling Up.
- Scaling Up makes no guarantee that CE credits will be accepted by your licensing board or employer.
- You are responsible for verifying CE eligibility with your regulatory/licensing authority.
5. Technology & Access Responsibilities
For online/virtual trainings, you are solely responsible for:
- Having a stable internet connection, updated device, and working audio/video.
- Keeping your camera on at all times during live trainings (required for attendance verification).
- Ensuring your environment allows for privacy and professional participation.
Scaling Up is not responsible for participant technical failures that result in missed training hours.
6. Cancellation, Refund, & Transfer Policy
Because trainings are time- and resource-intensive, Scaling Up enforces cancellation and transfer policies. The exact timelines, fees, and conditions vary depending on the training type (e.g., Basic Training, GAP Training, Intensives, On-Demand).
The applicable policy for your specific training will be provided to you at registration and forms part of this Agreement. By registering, you agree to abide by the training-specific cancellation and transfer terms.
General Principles (apply to all trainings):
- Cancellation and transfer requests must be submitted in writing.
- Administrative fees often apply to cancellations and transfers.
- Refunds apply only to the training registration fee; Scaling Up is not responsible for travel, lodging, or other costs.
- Once a training has started, refunds are not available; transfers may be offered only at Scaling Up’s discretion.

7. Copyright & Intellectual Property
- All Scaling Up training materials, website content, presentations, slides, recordings, and resources (“Content”) are the intellectual property of Scaling Up, LLC.
- Content may not be reproduced, shared, distributed, recorded, stored, or transmitted without prior written permission from Scaling Up.
- Use of Content is strictly limited to personal, professional development. Commercial use is prohibited.
- Unauthorized use of Scaling Up intellectual property may result in legal action, including injunctive relief.
8. Media Consent
Events may be recorded (audio, video, or photography). By attending, you consent to being recorded and waive any rights to inspect, approve, or receive compensation.
Recordings may be used for training, educational, or marketing purposes. If you do not consent, you must notify Scaling Up in writing before training begins.
9. Community Guidelines
Scaling Up communities (online and in-person) are professional spaces. By participating, you agree to:
- Be respectful and constructive; harassment or disruptive behavior will not be tolerated.
- Not solicit, advertise, or pitch services/products.
- Keep discussions confidential; do not share or repurpose content outside the group.
- Follow moderator instructions. Scaling Up reserves the right to remove any participant for violations.
10. Disclaimers
- Educational Purposes Only: Trainings, materials, and content are educational. They are not a substitute for medical, legal, or professional advice.
- No Guarantee of Results: Scaling Up makes no guarantee regarding outcomes, earnings, or clinical results from trainings.
- Accuracy: We strive for accuracy but do not guarantee that all content is current, complete, or error-free.
11. Limitation of Liability
To the maximum extent permitted by law:
- Scaling Up, LLC and its owners, trainers, contractors, and staff are not liable for any direct, indirect, incidental, or consequential damages arising from your participation in trainings or use of our content.
- You assume all risks associated with practicum exercises, participation, and application of learned techniques.
- Each trainee is independently responsible for their professional actions and required to maintain their own liability/malpractice insurance.
12. Indemnification
You agree to indemnify and hold harmless Scaling Up, LLC, its owners, trainers, contractors, and affiliates from any claims, damages, losses, liabilities, or expenses (including attorney’s fees) arising from:
- Your breach of these Terms;
- Your actions or omissions in connection with trainings, practicum, or consultation;
- Your reliance on Scaling Up content or services.
13. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the State of Nevada, USA.
- Any disputes shall be resolved through binding arbitration in Washoe County, Nevada.
- The prevailing party in arbitration or litigation is entitled to recover reasonable attorney’s fees and costs.
14. Severability
If any provision of these Terms is deemed unenforceable, the remaining provisions will remain valid and enforceable.
15. Acknowledgment
By registering, you confirm that you:
- Are at least 18 years old and legally competent to consent.
- Have read and fully understood these Terms.
- Accept full responsibility for your participation.
Waive liability claims against Scaling Up, LLC to the fullest extent permitted by law.
